You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account. With each account, it allows you to create many profiles with many characters based on the needs you want to have.
Our service is provided on an as-is basis. We reserve the right to modify or discontinue the service at any time without notice.
In exchange for our commitment to provide the Service, we require certain commitments from you. These commitments are vital for fostering a safe, inclusive, and law-abiding community within MetaSpace.
a. Who can use MetaSpace.
We aim for our service to be open and inclusive while ensuring safety, security, and compliance with the law. Therefore, we ask you to adhere to several restrictions to be a part of the MetaSpace community.
▪ You must be at least 13 years old or meet the minimum legal age requirement in your country to use MetaSpace.
▪ You must not be restricted from receiving any aspect of our Service under applicable laws or engaging in payments-related Services if listed on an applicable denied party listing. Your account must not have been previously disabled for violating the law or any of our policies.
▪ You must not be a convicted sex offender.
b. How You Can't Use MetaSpace.
Maintaining a safe and open service for a diverse community necessitates collective effort. Here's how you should not use MetaSpace:
▪ You cannot impersonate others or provide false information. While disclosing your identity on MetaSpace is optional, you must furnish accurate and current information, including during registration. Additionally, you may not impersonate someone or something you're not, and you cannot create an account for someone else without their explicit consent.
▪ You cannot engage in unlawful, misleading, fraudulent, or unauthorized activities.
▪ You cannot violate (or assist or encourage others to violate) our Terms or policies, including the MetaSpace Community Guidelines, Meta Platform Terms, Developer Policies, and Music Guidelines. If you post branded content, you must adhere to our Branded Content Policies, which necessitate the use of our branded content tool.
▪ You cannot interfere with or disrupt the intended operation of the Service. This includes abusing any reporting, dispute, or appeals channel, such as by submitting fraudulent or baseless reports or appeals.
▪ You cannot attempt to create accounts or access or collect information through unauthorized means. This includes automated account creation or information collection without our explicit consent.
▪ You cannot sell, license, or purchase any account or data obtained from us or our Service. This includes attempting to buy, sell, or transfer any aspect of your account or solicit, collect, or use login credentials or badges of other users.
▪ You cannot disclose someone else's private or confidential information without permission or infringe on someone else's rights, including intellectual property rights.
▪ You cannot modify, translate, create derivative works of, or reverse engineer our products or their components.
▪ You cannot use a domain name or URL in your username without our prior written consent.
You agree not to use the service for any unlawful or prohibited activities. This includes but is not limited to the dissemination of harmful content, spamming, or attempting to gain unauthorized access to other users' accounts.
We respect your privacy and handle your personal information in accordance with our Privacy Policy.
All content provided by the service, including but not limited to text, graphics, logos, and images, is the property of MetaSpace and protected by copyright laws.
MetaSpace shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the service.
a. Our agreement:
Your utilization of music on the Service is also governed by our Music Guidelines, while the use of our API is subject to our Meta Platform Terms and Developer Policies. Additional terms may apply if you utilize specific features or related services, such as agreeing to the Community Payment Terms for payment features. In case of conflict between these terms and the agreement, the latter will prevail. Should any aspect of this agreement be unenforceable, the remainder will remain effective. Amendments or waivers to the agreement must be in writing and signed by us. Failure to enforce any aspect of the agreement does not constitute a waiver. We retain all rights not explicitly granted to you.
b. Rights under this agreement:
This agreement does not extend rights to any third parties. You may not transfer your rights or obligations without our consent. Our rights and obligations may be assigned to others, such as in the event of ownership changes or by law.
c. Responsibility for outcomes:
Our Service is provided "as is," and we do not guarantee its safety, security, or flawless functionality at all times. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We are not liable for the actions, conduct, or content of users or third parties, online or offline. Our liability for incidents on the Service is limited as permitted by law. We are not responsible for lost profits, revenues, information, or data, or for consequential, special, indirect, exemplary, punitive, or incidental damages arising from or related to these Terms, including content, information, or account deletion.
d. Dispute resolution:
For consumers, the laws of their country of residence apply to any claims or disputes arising from these Terms, with resolution in a competent court in that jurisdiction.
e. Unsolicited material:
While we appreciate feedback and suggestions, we reserve the right to use them without restrictions or compensation. We are not obligated to keep them confidential.
a. We maintain the right to remove any content or information shared on the Service if we deem it to be in violation of our Terms of Use or policies, or if mandated by law. Furthermore, we may opt to refuse or discontinue providing all or part of the Service if it poses a risk to our community or services, or if it exposes us to legal liabilities. Such actions may be taken if there are repeated infringements on other people's intellectual property rights or to fulfill legal obligations. We retain the discretion to terminate or alter the Service, block content or information, or cease providing all or part of the Service if it is reasonably deemed necessary to mitigate any adverse legal or regulatory consequences. If you suspect an erroneous termination of your account or wish to disable or permanently delete your account, please contact us.
b. Upon your request to delete content or your account, the deletion process will commence automatically within 30 days. Deleting content may take up to 90 days from the initiation of the deletion process. While the deletion process is ongoing, the content will no longer be visible to other users but will remain subject to our Terms of Use and Data Policy. After the content is deleted, it may take an additional 90 days for us to remove it from backups and disaster recovery systems.
We reserve the right to modify our Service and Policies, which may necessitate changes to these Terms to accurately reflect our Service and Policies. Unless mandated otherwise by law, we will notify you (for instance, through our Service) before implementing any changes to these Terms, providing you with an opportunity to review them before they take effect. Should you continue to use the Service, you will be bound by the updated Terms. If you do not wish to agree to these or any updated Terms, you have the option to delete your account.
